Abstract: The control of general terms and conditions, producer
liability and a gradual shift of contractual risks from consumers to
suppliers of goods and services are necessary elements of consumer
protection. Its theoretical foundations are still unclear within
jurisprudence. The original theory of exploitation formulated by Fritz
Kessler and Ludwig Raiser is only partially valid and cannot explain why
serious consumer protection problems are also developing in markets
with an atomistic supply structure and a high level of competition.
George Akerlof’s theory of asymmetric information corrects this deficit
but fails to explain why consumers often do not prevail over large
firms. A flawed zero-sum theory of consumer protection, which is still
widespread among practitioners, is partly responsible for some grotesque
misguided developments in European consumer protection law. The lecture
introduces the theories of consumer protection and demonstrates absurd
and even economically dangerous effects of consumer protection This is
illustrated with an example related to the rules of damage compensation
in case of early repayment of mortgage loans.
